1. Scope of Application

These Terms & Conditions apply to all digital products offered by Izumi Tosa, specifically:

    • The Framework Recognition Guide 
    • The ChaosClarity™ Assessment for Coaches 

These terms apply in addition to any general website terms.

2. Right of Withdrawal for Consumers

Consumers have a statutory 14-day right of withdrawal for distance contracts.

However, your right of withdrawal expires when:

    • You have expressly consented to us beginning delivery before the withdrawal period ends, AND
    • You have confirmed your knowledge that you will lose your right of withdrawal once we begin delivery

By completing your purchase and requesting immediate access to your digital product, you provide this consent and acknowledgment.

3. Products & Delivery

The Framework Recognition Guide
 A 20-page digital guide delivered as PDF via email within 24 hours of payment confirmation. The guide includes self-assessment exercises and implementation instructions.

The ChaosClarity™ Assessment for Coaches
 A personalized analysis delivered as PDF via email within 5-7 business days of questionnaire completion. Includes custom Chaos Map visualization, 15 page written analysis, and prioritized recommendations.

Download links are valid for 14 days. You are responsible for downloading and securely storing your files within this period.

4. Payment

All prices are in Euros and are final prices.

As a Kleinunternehmer under § 19 UStG (German Small Business Regulation), no VAT (Umsatzsteuer) is charged.

Payment is due immediately upon order placement via Stripe payment processing. Access is granted after payment confirmation.

5. Rights of Use

You receive a simple, non-transferable, non-commercial right to use purchased digital products for personal use only.

You may not:

    • Reproduce, distribute, or publicly share the content
    • Modify, adapt, or create derivative works
    • Use the content for commercial purposes
    • Transfer your rights to third parties

The ChaosClarity™ trademark and all methodologies remain the exclusive intellectual property of Izumi Tosa.

6. Limitation of Liability

I apply reasonable care in creating and delivering all digital products. However:

I am liable without limitation for:

    • Damages from injury to life, body, or health
    • Intent or gross negligence
    • Claims under mandatory legal provisions

For slight negligence:

    • Liability is limited to foreseeable, typical damages
    • Liability exists only for breach of essential contractual obligations

Otherwise, liability is excluded to the extent permitted by law.

7. Data Protection

Personal data is collected and processed solely for contract fulfillment and in accordance with the GDPR. See our separate Privacy Policy for details.

8. Applicable Law

The law of the Federal Republic of Germany applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods.

For merchants and legal entities under public law, the place of jurisdiction is [your city].

9. Severability

If any provision of these terms is invalid, the remaining provisions remain in effect.
